Vorshalya Code of Conduct Appeal - Attopax - 01-29-2022

Vorshalya has appealed their punishment for a violation of Section IX.3, specifically subsections ©(b) and ©(d). Vorshalya has appealed on two grounds: 1) that it is not a violation because the conduct in question was not directed to another ISFL community member, and 2) that the punishment is not just given the conduct and other mitigating factors.

1) Section IX.3 does not only regulate conduct between community members. In fact, is specifically mentions public-facing outlets, like Twitter, that is related to the ISFL. Naturally, the ISFL is unable to police any and all personal accounts from members, but the ISFL does have a vested interest in policing any accounts that are affiliated with the ISFL in order to properly present our community's culture to the public. Consequently, the rules clearly show an intent to regulate any conduct to anyone while operating as a representative or member of this community. Therefore, Head Office's interpretation of this conduct as a violation of Section IX.3 is clearly established.

2) Head Office elevated the punishment because of a previous violation. However, the previous violation was approximately 11 months ago. Therefore, although there is a history of previous violations, it is a remote history and a mitigating factor in terms of classifying the individual as a "repeat offender." Additionally, Vorshalya has expressed a desire to no longer be affiliated with the ISFL on Twitter and has already started taking preventive steps to avoid re-offending by distancing his account from the ISFL. League leadership is unable to provide an enumerated list of how to accomplish this, and we can only recommend to err on the side of caution and take the conservative approach. The responsibility to do this rests with Vorshalya. Therefore, due to the large gap in time between offenses and due to the steps taken to prevent misrepresenting the ISFL in the future, the Appeals Team has elected to amend the punishment as follows:

- Twitter ban upheld.
- Forum/Discord ban reduced to end February 7th.

This vote was unanimous.

Addendum: The Appeals Team denounces Vorshalya's conduct and behavior in the strongest possible terms, and unequivocally state that the results of this appeal should not be construed as making light of the comments made. The decision made in this appeal is based on the rule of law in light of the guidelines set forth by league leadership and the published rulebook; however, the Team wishes to publicly state that we are trusting Vorshalya to follow through with his stated desire to not represent the ISFL in a negative light. This is a courtesy being provided to him based on the specific facts of the case. Although the time between punishments was a mitigating factor in this case, the Appeals Team considers Vorshalya to be on notice as to how seriously league leadership treats "trolling" and otherwise inappropriate behavior that represents the ISFL community in an unflattering way, and firmly states that any future violations will be adjudicated very differently.

UPDATE:

Following the above decision,  community members submitted an overwhelming amount of additional evidence and argument to Appeals. Of note, some of this evidence indicated that the Vorshalya's conduct was not limited to Twitter and showed zero respect or regard for the league's rules. In short, the Appeals Team clearly did not have all of the evidence prior to making a decision.

Because this is the first time something like this has happened and the rulebook is silent to it, it took time to determine whether Head Office or Appeals Team was in the best position to address this development from a rules perspective. After discussing it amongst ourselves and Head Office, in light of this new information, Appeals Team has voted to reconsider the prior decision in light of new evidence.

Because of the heavy weight placed on Vorshalya's apparent desire to comply with and respect league rules, this new evidence eliminates one of the major mitigating factors used in the prior decision. In addition, the new evidence shows a lack of concern for the league's health. Therefore, the Appeals Team has voted to uphold the original punishment.

Are you serious? This is a joke right? He got punished AND THE NEXT FUCKING DAY did the EXACT same thing and made trash comments in a LR. Awful

Thought I should add to this as to why after reading Zayn's comments below to help further back up his point, as before this individual deleted his twitter he was calling people child molesters, all in the name of "political discussion".

This tweet and maybe 20 other messages where posted AFTER he got the ban, he has been posting stuff like this for months towards fans of other NHL teams, just did not get reported til now


He conveniently deleted his account when he appealed so I’m guessing all the other trashing thing he said unfortunately can’t be included as I only screenshotted one when I saw the “punishment.”

Biggest miscarriage of justice since @LB3737 wasn't banned for tampering

Sexist docuhebags who show no remorse or understanding why what they're saying is wrong have no place in this league. He wasn't just a repeat offender, he was a *constant* offender, before and after he was punished before his behavior. This is far worse than what zamir/dylandeluxe/anyone else who's been permanbanned has done.
